House Rules/Rental Agreement

Prospective Guest must agree to abide by the terms of our Rental Agreement as a prerequisite to Owner confirmation of booking request. The full Agreement is listed below and by making a booking request, Guest accepts all Agreement terms and conditions.

PROPERTY ADDRESSES: Black Moose Road ~ Lazy Acres ~ West Yellowstone, MT 59758

CHECK-IN TIME is 4 P.M. MT AND CHECK-OUT is 10AM MT. No early check-in or late check-out without prior Owner agreement.

SMOKING - These are NON-SMOKING properties.

PETS – PETS are not permitted in Lazy Moose Lodge or Mountain View Lodge under any conditions. With Guest’s notification and Owner’s permission prior to booking confirmation, Guest may have one (1) well-trained dog at the Mini-Moose Cabin.

DAMAGE DEPOSIT – ($250 - Mini Moose, $500 Lazy Moose and Mountain View Lodge) Refundable damage deposit is required upon check-in. 

PAYMENT – We accept Visa, MasterCard, American Express and Discover.  50% deposit of total to be charged at time of reservation and the remaining balance will be charged 30 days before arrival. 

CANCELLATIONS – 60 day cancellation policy with $100 Cancellation Fee.  Any cancellation within 60 days of arrival or earlier will forfeit their deposit. 

MAXIMUM OCCUPANCY – Without prior Owner agreement, the maximum number of guests is limited to ten (10) persons, of which no more than eight (8) can be adults, for the Lazy Moose Lodge and Mountain View Lodge and six (6) persons, of which no more than four (4) can be adults, for the Mini-Moose Cabin.
Note: The Mini-Moose Cabin is ideally suited for two (2) adults and two (2) to four (4) children. Should Guest’s party have more than two (2) adults, Guest acknowledges awareness of the sleeping arrangements as stated in Owner’s property listing – i.e., single queen bed and bunk beds in Master Bedroom and queen sleeper sofa in Living Room, and a single bathroom.

MINIMUM STAY – This property requires a minimum night stay depending upon rental season - i.e., Winter, Spring and Fall require 3-nights, whereas Summer and Christmas/New Year require 4-nights. If a rental is taken for less than the required minimum stay, the guest will be charged the minimum stay rate.

INCLUSIVE FEES – Rates include a one-time linen and towel setup.

CONDITION AND USE OF PROPERTY - The property is provided in “as is” condition. Owner shall use its best efforts to ensure the operation of all amenities in the property, such as internet access, satellite or cable TV access, fireplaces as applicable. Owner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
Guest shall use the property for residential purposes only and in a careful manner to prevent any damage or loss to the property and keep the property in clean and sanitary condition at all times. Guest
and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the property.

NO DAILY HOUSEKEEPING SERVICE – While ample linens and bath towels are included in the property, daily maid service is not included in the rental rate. Given that each property is equipped with a clothes washer and dryer, we do not permit towels or linens to be taken from the properties for cleaning or any other purposes.

DAY OF CHECKOUT - On day of check-out, please wash dishes, wash INITIAL load of towels and linens (not necessary to dry them) and empty/secure trash in supplied dumpster.

RATE CHANGES – Rates are subject to change without notice; however, rate changes will not affect existing executed rental agreements.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

PARKING/DRIVING - Vehicles are to be parked in designated parking areas only. Parking on Black Moose Road is not permitted. Any illegally parked cars are subject to towing and applicable fines/towing fees are the sole responsibility of the vehicle owner. Speed limit on Black Moose Road is 15 mph and is strictly enforced.

FIREPLACES – The fireplace in each property is a high-efficiency wood-burning firebox that MUST be operated per the instructions provided to properly function. Pre-cut/packaged firewood bundles are available for purchase at any number of convenient retail store locations in West Yellowstone.

WATER AND SEWER SYSTEM – These properties are connected to deep-water wells and septic tank systems. The septic tank system is very effective; however, it will clog if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, Guest could be charged for the full cost to repair.

STORM POLICY– No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel street and drives are well maintained; however, we highly recommend four-wheel or front-wheel drive and/or chains during the heavy snow months. Owner does not refund due to road conditions.

TRAVEL INSURANCE – We recommend that all guests give consideration to purchasing travel insurance.

RESPONSIBILITIES - Each of the properties is privately owned. The Owner is not responsible for any accidents, injuries or illness that occur while on the premises or in the properties. The Owner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises and properties or any others whom they invite to the premises or properties.

RELEASE - Guest hereby waives and releases any claims against Owner, the Owner’s agent and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the property, including any common facilities,
activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.

ENTRY AND INSPECTION - Owner reserves the right to enter the property at reasonable times and with reasonable advance notice for the purposes of inspecting the property. If Owner has a reasonable belief that there is imminent danger to any person or property, Owner may enter the Property without advance notice.

UNAVAILABILITY OF PROPERTY - In the event the property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Owner, Owner will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Owner shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved by Owner in writing in advance.
